Lawyer Jailed After Protesting Jury Service in Email to Judge

Judge Lopez holds her in contempt, jails and fines her $500 for jeopardizing civil trial

An Atlanta in-house lawyer spent a night in jail after she improperly contacted a DeKalb County judge by email, saying that she would "blame the plaintiff" in a trial for which she had been selected as a juror because she'd have to work nights and weekends to attend to her own client.

    Perhaps Ms. Beaty is held to a higher standard because when she took the oath as an attorney in the Great State of Georgia she promised to support and defend the Constitution of the United States and the Constitution of the State of Georgia. If attorney‘s do not support a person‘s right to a fair trial by jury, who will?

    I have never been called to serve - though I would gladly serve if asked and I would hope that it would be interesting. That being said, I have a friend who makes his living as a commission only salesman. If he misses a day (let alone one week or more) - he will not be able to pay his bills and survive. Last year, he was called to serve on a jury. He wrote the judge and indicated it would be a financial burden if he happened to be on a case that lasted weeks. The judge did not care and ordered him to appear. Just his luck, he was in a group of 100 jurors that were going to sit as jurors on a murder trial. It was a well known & complicated case that was estimated to last 2 to 3 weeks (indeed, it lasted 4 weeks). Knowing this would lead to him financial ruin, he said the following during voir dire: "I believe in the death penalty for all murderers and if this guy is found guilty I will vote for the death penalty. I also think that child molesters should be shot on the spot."

    The defense attorney excused him and he was back at work in 2 hours.

    Bravo for the Judge. This type of "me first" conduct on the part of Ms. Beaty is reprehensible, but it demonstrates the thinking on the part of a great number educated people who will do almost anything to get out of jury duty and whose refusal to serve on juries threatens the viability of the jury system. Ms. Beaty will be the first to question the irrational nature of many jury verdicts and wonder why juries aren‘t collectively smarter.
