Overruling a three-judge panel's decision, the full U.S. Court of Appeals for the Eleventh Circuit last week rejected the claims of a death row inmate who contends his trial counsel should have told the jury about a head injury he suffered as a 3-year-old that his experts say caused significant and permanent mental problems. Judge Charles Wilson (above) protested the court's decision to take up the case en banc.
