“Courts' debt may violate state law,” mistakenly included the Georgia Court of Appeals among legal entities that may have violated the state constitution by entering the new fiscal year in debt. A representative of the appeals court did not tell lawmakers at an Oct. 27 hearing that the court entered the new fiscal year in debt. She said that the court submitted an enhancement request for $58,900 for a portion of a contract with a vendor for services not yet rendered. The contract had been modified due to Gov. Sonny Perdue's request that courts cut 25 percent of their June budgets.

An Oct. 26 story about finalists for a judgeship on the Fulton County Juvenile Court misstated a prior position for finalist Juliette W. Scales; she was a special assistant attorney general representing the Fulton County unit of the Division of Family and Children Services. The story also misstated the name of her law school, the Washington College of Law at American University.

An Oct. 15 story from The National Law Journal, “Justices question 'very, very, very high' fees,” misattributed a statement from oral arguments over a fee-shifting statute. It was Justice Samuel Alito—not Chief Justice John Roberts—who told Paul Clement, arguing that judges should be allowed to award fee enhancements, that perhaps Clement's perspective on the issue had changed since Clement left his post as U.S. Solicitor General and joined King & Spalding. Alito said, “Your argument is that, you know, for $495 an hour you really can't get a good lawyer?” The online version of this story has been updated to include the correct information.

An Oct. 9 story about candidates for an open seat on the Fulton County Superior Court contained two errors in the section about prosecutor Robert D. Wolf, one of the five finalists for the post. The story mischaracterized Wolf's response to a question about litigation experience in his application to the Judicial Nominating Commission. Wolf stated only that the prosecution of Yiu Fei Shih (misspelled as “Sheh” in the story) was among his “more significant” cases; Wolf did not say the prosecution was successful. Shih was acquitted of all charges in that case.

The Oct. 6 story, “Plaintiff considers appeal of $1.1 million award,” misreported that a defense lawyer in the case, state Rep. Edward Lindsey, co-sponsored legislation in 2005 that changed state tort law to allow for the apportionment of damages. Lindsey voted against Senate Bill 3.

A cutline in the Sept. 25 Daily Report misrepresented DeKalb District Attorney Gwendolyn Keyes Fleming's position on certain proposed changes to the juvenile code. Fleming didn't say she was “against” raising the age from 17 to 18 that juveniles can be prosecuted as adults in cases involving serious crimes. In an e-mail to the Daily Report that was used in preparing the story, Fleming didn't take a personal position on raising the age though she said prosecutors were against making “sweeping changes in this area.”

The second item in a Verdicts & Settlements story on Sept. 2 dealt with a woman's $1.1 million settlement of a suit she brought against multiple parties after her car was struck by another car. The plaintiff's lawyer said that Georgia Farm Bureau Mutual Insurance, which insured the plaintiff for accidents caused by uninsured motorists, had resisted paying for the plaintiff's medical bills. In an Sept. 9 e-mail to the Daily Report, Georgia Farm's lawyer, Charles A. Wiley Jr., wrote that the defendant driver of the car was insured by another company, so “Georgia Farm paid nothing, which was totally appropriate.”

Brennan as saying his client settled a suit by paying $1.4 million for a plaintiff's future medical damages. Brennan said his client paid $4.1 million for medical damages and another $1.3 million for pain and suffering.
